Abstract
background The assessment of the severity of a paraphilic disorder is of great importance, especially in the assessment of criminal responsibility and the indication of measures. The minimum criteria for the assessment of criminal responsibility in cases of so-called "serious other mental abnormality" formulated by the interdisciplinary working group at the Federal Court of Justice define the standard for this. Aim of the work and methods The aim of this article is to present a research concept that uses criteria from prognostic instruments to measure the severity of a paraphilic disorder in order to assess criminal responsibility. Results and discussion In addition to the formal diagnosis according to ICD or DSM, the characteristics "deviant sexual interests" and "sexual over-employment/urge" from the "Stable 2007" prognosis instrument are used for assessment. Other criteria (e.g. "attachment and relationship deficits") underline the severity of the disorder. The characteristics "paraphilic sexual urge", "emotional breakdown" and "breakdown of social support" from the "Acute" prognosis instrument are considered relevant for the psychiatric assessment of the ability to control oneself. The usability and reliability of the proposed research concept will be empirically tested in a next step.
