Family law has undergone significant reforms in recent years, primarily regarding filiation, with the affirmation of the unique status of children, whether born within marriage or not; civil unions; and de facto cohabitation. Much has been done, but much remains to be done: just think of the pressing demand to modify the legal regime of community property and the rules regarding maintenance for a separated spouse or former spouse , as well as, more generally, the need for a comprehensive reform of the matter, capable of responding to the profound social and customary changes that have occurred since the 1975 reform. Recent case law has highlighted the growing inadequacy of holographic wills, given that handwriting can be considered virtually extinct, and increasingly, elderly (not incapacitated, but) particularly frail people are left in the care of strangers. And uncertainties remain, despite a recent ruling by the Supreme Court of Cassation, also regarding the distribution of the burden of proof of the falsity of a will. Furthermore, the debate over the reform—desired by many—of compulsory succession has not subsided, at a time when the prolongation of human life has made the need for child protection less relevant. Familia aims to contribute to the evolution of family and inheritance law through a thoughtful exchange of ideas from leading Italian and international specialists. Comparison with the experiences of other European countries, in a context that has seen a once-unpredictable increase in the number of marriages between people of different nationalities and in cross-border inheritances, and constant attention to case law are the key methodological guidelines that will guide the writing of the essays and commentaries.
